CNN —A Tennessee judge has temporarily blocked the NCAA from enforcing parts of its interim policy that would have restricted how student athletes negotiate compensation for their names, images and likeness. The so-called NIL policy included NCAA bylaws that would have prohibited student athletes from negotiating with any third-party entity, including schools or boosters. To be sure, it is pure speculation to assume that student-athletes would receive more lucrative NIL deals in an open market. Fair market value may be equal to or less than the NIL deals student-athletes can currently receive after selecting a school. But without the give and take of a free market, student-athletes simply have no knowledge of their true NIL value.

The attorneys general of Tennessee and Virginia filed a lawsuit against the NCAA on Wednesday, a day after the University of Tennessee's chancellor ripped the association for investigating the school for potential recruiting violations related to name, image and likeness compensation rules. The lawsuit filed in the Eastern District of Tennessee claims the NCAA is “enforcing rules that unfairly restrict how athletes can commercially use their name, image and likeness at a critical juncture in the recruiting calendar." Tennessee released a scathing letter Chancellor Donde Plowman wrote to Charlie Baker shortly after school officials met with NCAA representatives to discuss the allegations. The person spoke to the AP on condition of anonymity because both the school and the NCAA were not immediately releasing information regarding an investigation. The person said Tennessee has not received a notice of allegations from the NCAA. The NIL collective that supports Tennessee athletes, Spyre Sports Group, was among the first and most well organized to emerge around the country after the NCAA lifted its ban on athletes making money off their fame. The NCAA fined Tennessee more than $8 million last July to cap an investigation started by the university in November 2020. The head of the panel ruling on the investigation called the violations “egregious and expansive” with Tennessee failing to monitor its football program.
